Your Estimate/Order Form (the “order”) for Bronto Cloud Services identifies the Subscription Services Agreement that governs the order. If your order is placed on or after July 1, 2020 and references the Subscription Services Agreement available at https://www.netsuite.com/portal/resource/terms-of-service.shtml or www.netsuite.com/tos, then the July 1, 2020 version of the Subscription Services Agreement applies to that order. For any “add-on order” to an original Cloud Services order, the version of the Subscription Services Agreement for Bronto Cloud Services in effect on the date of the original order will apply to the add-on order, even if the add-on order is placed after an updated version of the Subscription Services Agreement is published. An “add-on order” is an order that updates the quantity or type of previously ordered Bronto Cloud Services, such as by adding capacity, new user subscriptions, or additional SaaS service applications.

If your order for Bronto Services was placed before July 1, 2020, this Bronto Online Professional Services Addendum governs professional services and training provided by Oracle to Customer. The Bronto Online Professional Services Addendum is incorporated into the Bronto Subscription Services Agreement (released in October 2019) and the Transactional Bronto Subscription Services Agreement found at http://content.bronto.com/terms/terms-and-conditions/.

The Bronto Permission Marketing Policy governs your use of the Bronto services and Oracle’s policy around sending unsolicited bulk email or “spam” through the Bronto services. The Bronto Permission Marketing Policy is incorporated into the Bronto Subscription Services Agreement (released in October 2019), the Transactional Bronto Subscription Services Agreement found at http://content.bronto.com/terms/terms-and-conditions/ or via your Estimate/Order Form for orders placed on or after July 1, 2020.

If your Estimate/Order Form with Oracle for the NetSuite services was placed before April 16, 2018 and incorporates in the NetSuite Data Processing Addendum, then the April 2017 version of the Data Processing Addendum below applies to your orders unless it is otherwise specified in this Data Processing Addendum, the Estimate/Order Form, the Subscription Services Agreement or License Agreement that governs your Estimate/Order Form.

If your Estimate/Order Form (“order”) with Oracle for the NetSuite service is placed on or after April 16, 2018 and before September 12, 2018 and incorporates in or does not expressly exclude the Data Processing Agreement for Oracle Cloud Services (“Data Processing Agreement”) available at www.oracle.com/contracts, then the January 12, 2018 version of the Data Processing Agreement automatically applies to your order.
If your Estimate/Order Form (“order”) with Oracle for the NetSuite service is placed after September 12, 2018 and incorporates in or does not expressly exclude the Data Processing Agreement for Oracle Cloud Services (“Data Processing Agreement”) available at www.oracle.com/contracts, then the July 27, 2018 version of the Data Processing Agreement automatically applies to your order.
